1. Scope of Agreement
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, including our Payment Policy, Shipping Policy, Return Policy, and Privacy Policy, without limitation or qualification. Any purchase of products made through the Site constitutes a legally binding agreement formed through electronic means in accordance with applicable laws governing online and distance transactions. The agreement is deemed concluded once you receive an automated order confirmation email following your purchase.
2. Conclusion of Contract
The product descriptions displayed in the online shop do not constitute binding offers. The customer, by clicking the “place an order” button after completing the purchase form, makes a binding offer to enter into a purchase contract with OMX Graphics pursuant on the terms contained in the purchase form. OMX Graphics is not obliged to accept the offer. OMX Graphics submits a purchase confirmation to the email address stated by the customer, thereby the purchase contract is concluded.
3. Intellectual Property
All intellectual property rights, including but not limited to trademarks, texts and logos displayed on our products, belong solely to their respective owners. Our rights and claims pertain only to the specific products, designs and pictures offered under the OMX Graphics brand and is protected by international laws governing intellectual property protection, including laws governing copyrights and trademarks. Our trademarks may not be used in any manner for any purpose without our express written consent.
4. Website Disclaimer
OMX Graphics undertakes no warranty that the information provided on the Site is accurate, complete, or up-to-date. OMX Graphics reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after the Client has submitted the Client’s Order). Product images on the Site are for reference only. The actual product appearance may slightly vary. We attempt to be as accurate as possible when describing our products on the Site. If the product-related information (image, description, colors, etc.) has changed, OMX Graphics cannot guarantee that the data posted on the Site at any given moment contains all the latest updates. Every effort is made to keep the Site up and running smoothly. However, OMX Graphics takes no responsibility for, and will not be liable for, the Site being temporarily unavailable due to technical issues beyond our control. Through links posted on this Site, you can get to other websites which are not under the control of OMX Graphics. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
5. Colors
All colors on OMX Graphics site have been represented as accurately as possible. However the accuracy is dependent on your monitor settings and calibration. In most cases the colors will vary slightly.
6. User Responsibilities
In the access or use of the Site, you shall comply with these Terms and Conditions, Payment Policy, Shipping Policy, Return Policy and Privacy Policy and instructions for access or use posted on the Site. You shall always act in accordance with the law, custom and in good faith. You may not make any changes or alterations to the Site or any Content or services that may appear on this Site and may not in any way impair the integrity or operation of the Site. Without limiting the generality of any other provision of these Terms and Conditions, if you default negligently or willfully in any of the obligations set forth in these Terms and Conditions, you shall be liable for all the losses and damages that this may cause to omxgraphics.com, our affiliates, partners or licensors.
7. Pricing and Payment Process
No taxes are charged on orders shipped to customers in the United States.
Prices on OMX Graphics are given in USD. However we also display prices in EUR. Exchange rates are updated weekly. The value added tax (VAT) included in the price of all products. Shipping costs vary due to product type, amount and weight. Prices are subject to change without notice. If we receive an order from you indicating a different price than that on the website at that time, we will contact you and offer you a chance to cancel your order. All duties and taxes required to be paid to receive the shipment in your delivery destination except USA are to be paid by you. The client makes the payment after the order has been processed. Invoice / order confirmation is automatically generated and sent to client’s email.
8. Production and Delivery time
Design preview is emailed for approval in 3-7 workdays days after you place an order. Delays may occur during high sale seasons (Black Friday, Cyber Monday, Christmas Sale, etc.) as well as our current work load. During and after this period design preview can take up to 15 business days. Our standard production time on custom graphics is 2-3 workdays, on mx jerseys 5-7 workdays, on mx seat covers 8-15 workdays after your final approval is received. FedEx worldwide delivery takes 3-10 business days depending on selected shipping method. Please note that shipping delays may occur due to the heavy workload of courier companies and are not controlled by OMX Graphics in any way. Selected shipping method does not affect designing and production time.
9. Warranty, Returns & Exchanges
All products have 30 days limited warranty from the date of delivery (unless provided otherwise) for manufacturer’s defects or errors (you received an incorrect or defective item) only. During the limited warranty period, OMX Graphics will replace, at its sole discretion, any defective, unused graphic or offer a refund. For return process read Return Policy. OMX Graphics is not accountable for improper installation of graphics, damage to them due to faulty installation techniques, or regular wear and tear and race abrasions. Please double check your order form before placing it, as your order will be printed with the colour choices, race number, template, spelling and logos that you specified. Once your order is printed no changes can be made. After receiving the product, please make sure that the material is free from any flaws and the fitment is as ordered. Once you have started to install or use our product, we are unable to offer you a refund or exchange it. Please note that we cannot accept returns on any custom made products for any reason other than error on our part as they are custom made for each customer. You may cancel your order and receive a full refund if it has not been processed yet by writing us an e-mail within 24h from the order date. If you’re cancelling the order when the designing has been started, 25% will be withheld as a designing fee. There will be an extra 40 USD charge for a new design in case you decide to completely change the one that’s already has been made.
10. User account and order list
OMX Graphics will make your order list available automatically. You will need to get a password to access your orders. Password link will be sent to you by e-mail.
11. Force Majeure
OMX Graphics shall not be held responsible for any delays, failures to fulfil obligations or any other failures that occurred due to circumstances and obstacles that are beyond our reasonable control, which include but are not limited to strikes, governmental actions, wars or national emergencies, terrorism threats or acts of terrorism, environmental or climatic anomalies, failure of performance by a third party, internet connection issues as well as hardware and software malfunction. In the event that any such force majeure occurs we will try to eliminate any delays in the shortest time possible.
12. Miscellaneous
These Terms and Conditions constitute the complete and current agreement between you and omxgraphics.com regarding your use of the Site and any related content, products, or services. They supersede all prior or contemporaneous agreements, communications, or understandings. This Agreement shall be governed by and interpreted in accordance with applicable laws, without regard to conflict-of-law principles or international conventions governing the sale of goods. OMX Graphics reserves the right to modify or update these Terms and Conditions at any time by posting the revised version on the Site and updating the effective date. Any such changes take effect immediately upon posting. Your continued use of the Site following the posting of changes constitutes your acceptance of the revised Terms.
